Well, according to the following person: Craig Watson Senior Mining Registrar, Field and Land Access Brisbane District Office Mineral and Coal Operations
Department of Natural Resources and Mines
"It is my view that a river sluice and cradle are hand tools, if no machinery is involved. This view is to be taken in conjunction with the water course requirements of the Fossicking Act."
I am not a solicitor, but I doubt his "views" would stand up in court but at least it is a starting point.
