I have been reading the reg for Victoria about prospecting and all the you can do and can not do. I just want some clarification on prospecting/fossicking with just hand tools e.g.. detector and small river sluice on an area that is covered by an exploration license. From what I can make of the regs the person or company that has the exploration license has rights to any minerals found. Need a bit of advice on the way to approach a creek that runs through my property for example that may have gold in it, and what would be the fall out if I got caught with my river sluice in it by the company that holds the exploration license. Any info would be good.

I'm not really sure on this point except from my own personal experience with one company. The company in question holds exploration license over a large area of one place I detect. I actually went in to their office one day some years back & asked them what their policy was on prospectors detecting on their EL areas. They said they didn't care about prospectors detecting anywhere in those areas. Like I said, this is only one particular company in one particular area, but other companies might have a different view.
